What is an Appeal?

An appeal is a challenge to a previous legal decision made by a lower court, such as a trial court. In other words, it’s when a litigant asks a higher court to reverse a decision of a lower court. 

Interestingly, appeals can be made whether you won or lost your case since there are numerous issues contained within a judgment, some of which may include (among others):

  • errors in applying the law

  • errors in pre-trial rulings that affected the case

  • evidence that was improperly admitted or excluded

The fact that there is a “judgment” that’s not in your favor does not necessarily mean the situation isn’t correctable if there was an error. Errors can range from seemingly minor to glaringly obvious — and any of them can have a major impact on your case. Even when these errors are present, if they were not preserved on the record by an attorney who understands the importance of the appellate process, you may not be able to address them with a higher court.

FAMILY LAW APPEALS

Our largest volume of casework in family law appeals tends to be in the highly complex and delicate areas of Termination of Parental Rights (TPR) and adoption matters. Divorces may sometimes be straightforward proceedings but, more often, they are complex, emotionally charged and drawn-out, which creates complicated situations that can end in errors by the trial judge. 

In any type of family law case, these errors can happen not only at the end of the case when a final decision or judgment is rendered, but sometimes before the end of the case, including in temporary orders made during the process. If those errors are not challenged, they become permanent and enforceable, so timely action is critical.

CRIMINAL LAW AND POST CONVICTION APPEALS

When you’ve been charged and convicted of a crime, you should consult with an appellate lawyer to determine if any errors were made that may have impacted your case negatively. Since a criminal conviction can have many collateral consequences in addition to the loss of freedom and hefty financial penalties, addressing and attempting to overturn a conviction could have many positive, life-altering implications. Grounds for a post conviction could include, but are not limited to:

  • Errors by the judge during trial

  • Prosecutor misconduct
